By accessing our website, using our website, using our services, submitting a report, or interacting with our community, you agree to be bound by these Terms of Service and Terms of Use (“Terms”), which may change from time to time. Please be sure to visit this site and web page often to see if anything has changed. If we post changes and you continue to use the site, you will be deemed to have agreed to the changes.

1. PRIVACY POLICY INTEGRATION

Your privacy is important to us. Our collection, use, and sharing of your personal information (including IP addresses, contact information, and exact GPS locations) are also governed by our Privacy Policy. By agreeing to these Terms, you also acknowledge and consent to our data practices as described in these Terms and our associated Privacy Policy.

Found Rescue makes no warranties of any kind, whether expressed or implied, as to the accuracy, reliability, or completeness of any information or content provided on this website. Found Rescue specifically disclaims any express or implied warranties of merchantability or fitness for a particular use or purpose and any warranty of non-infringement, with respect to the content of, and information on this website. All of the information, documentation, artwork, trademarks, audio, video, and other content of this website is strictly made available on an “as is” basis without warranty of any kind.



3. SERVICES OFFERED

Found Rescue provides several animal welfare and community services, this includes, but is not limited to:

• The Found & Lost Pets Database: We offered a free-of-charge community directory and database designed to facilitate the safe return of lost pets to their families. Users can report found or missing animals by submitting detailed descriptions, uploading photos, and providing exact GPS coordinates to pinpoint the pet's location. To actively aid in reunification, the platform automatically generates printable flyers, among other features.
• Lost Pet Reunification: Operating from our headquarters in Tucson and supported by a nationwide network, we use microchip scanning, lost-and-found databases, and community outreach to safely return lost pets to their families.
• Rescue: We step into crisis situations to rescue the most vulnerable cats and dogs—the abandoned, abused, injured, and forgotten—pulling them from the streets or high-risk shelters.
• Trap-Neuter-Return (TNR): We engage in humane, scientifically proven population management for community (feral and stray) cats. Cats are trapped, spayed/neutered, vaccinated against rabies, ear-tipped, and returned to their outdoor homes.
• Rehabilitation & Foster Care: Operating without a traditional shelter facility, 100% of our rescued animals are placed directly into our dedicated network of foster homes across Arizona and beyond to recover physically and emotionally.


4. AGE REQUIREMENTS

You must be at least 18 years of age to register an account, submit a pet report, apply to foster or adopt, or make a donation on our platform. By using this website, you represent and warrant that you meet this age requirement. We do not knowingly collect personal information from children under the age of 13.



5. ACCEPTABLE USE AND USER CONDUCT

You agree not to use Found Rescue to:

• Submit false, misleading, or spoofed pet reports.
• Harass, threaten, or send unsolicited spam/scam messages to users via the "Message the Finder" form.
• Scrape, data-mine, or extract user contact information for commercial purposes.
• Distribute viruses, malware, or interfere with the proper functioning of our website.


6. TERMINATION

Found Rescue reserves the right to terminate your access to the Site, without any advance notice.



7. REPORTING & POSTING GUIDELINES
• Found Rescue is a platform for LOST and FOUND pets ONLY.
• Please do not include personally identifiable information about other individuals in your posting.
• Please do not use profanity.
• Only images of your pet or a pet you found should be submitted. Please do not submit images of anything else.
• Must be 18+ years of age to post on Found Rescue.
• Please do not include links to other sites in the post message.
• Report or Posts may require approval before being displayed.
• Found Rescue does not take part in foster care or custody disputes. If you believe someone has wrongful custody of a pet, Found Rescue is not the place to resolve that dispute.


8. PET REPORTING AND PUBLIC INFORMATION

When you submit a pet report on our platform, you agree to provide truthful and accurate information.

• Information Collected: We request the Pet Name (if any), Pet Type, Color, Gender, Size, Date Found, Status (who is looking or if reunited), City Found, State, Description, your Full Name, Contact Number, and Email Address. You may upload up to 10 images. We also capture and record your exact location via GPS coordinates and IP address.
• Public Use of Information: To aid in reunification, the Finder’s Name, Phone Number, GPS coordinates, and exact location pinpoint will be publicly available to everyone and printed on automatically generated flyers.
• Internal Use: Found Rescue will use this information to contact the finder by email or phone.
• Flyer Distribution: If you print and distribute physical flyers generated by our platform, you are solely responsible for complying with all local laws, HOA rules, and city ordinances regarding the posting of signs. Found Rescue is not liable for any fines, penalties, or disputes arising from illegally or improperly posted flyers.


9. USER-GENERATED CONTENT, PHOTOS, AND COPYRIGHT TRANSFER

By uploading photos (of pets, locations, etc.) to the Found Rescue website, you agree to the following:

• Copyright Transfer: You are releasing and transferring the full, irrevocable copyright of those photos to Found Rescue, LLC.
• Usage Rights: We will use these photos to broadcast the report through multiple web platforms, social media platforms, mobile applications, and for Found Rescue marketing without compensation, attribution, or further permission.


10. PUBLISHING OF CONTENT

You hereby acknowledge and agree that you are solely responsible for all materials that you approve for publishing, display, and distribution by us in connection with the Services, or that you post, publish or distribute in connection with the Services, including without limitation, advertisements prepared by us for you (including all information, trademarks, and photographs contained in such advertisements), information, data, text, software, links, photographs, pictures, graphics, video, messages, files and any other materials (“User Content”). You represent, warrant and agree that no User Content that you approve for publishing, display, and distribution by us, or submitted by you or through your account, will: violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; contain libelous or defamatory material; or violate or encourage violation of any applicable, laws, regulations, rules, professional codes, codes of ethics, administrative laws, codes of conduct or standards (including, without limitation, rules, standards or codes of conduct for non-governmental or quasi-governmental associations), e.g., federal, state, or local laws, regulations, rules, professional codes, codes of ethics, or administrative laws.


For the purpose of clarity, by using us to publish and distribute an advertisement prepared by us for you, you are approving the publishing of such advertisement by us on your behalf. You represent and warrant that you have all legal rights necessary to publish and distribute (or necessary to have us publish and distribute) any User Content or that you own such User Content. You represent and warrant that the advertisement prepared by us for you will comply with all applicable laws, rules, and regulations.



11. MESSAGE THE FINDER & USER SAFETY

To protect your email address, it will not be displayed publicly on the website. Instead, we offer a "Message the Finder" feature on all reports.

• Anyone can use this feature to contact the finder by providing their Full Name, Email or Phone Number, and a message. This information is routed directly to the Finder so they may contact the possible owner.
• No Liability for User Communications or Meetups: Found Rescue does not background-check general users messaging finders. We are not responsible for communications, meet-ups, or exchanges between users, finders, and potential owners. You agree to exercise extreme caution, meet in safe, public locations (such as a police station parking lot), and prioritize your personal safety when communicating with or meeting third parties.


12. STATUS OF FOUND PETS AND REPORT AVAILABILITY

Pets in our database will be assigned one of three statuses: 1. Found, "Looking for the Owner," 2. "I'm the Owner," looking for the pet, or 3. "Reunited with Owner".

• Updating Statuses: Statuses may not always be up to date. To update a pet’s status, the user must be a registered, active member of the Found Rescue community. Non-registered users must contact Found Rescue to request a status update.
• Data Purging: We reserve the right to periodically purge pet reports that were submitted over 5 to 6 months prior. Once purged, these reports and their associated data will no longer be available.


13. PROHIBITION ON FALSE CLAIMS AND PET THEFT

Found Rescue takes the safety and legal ownership of animals very seriously. You strictly agree NOT to submit a false claim of ownership over a found pet. Attempting to claim, intercept, or take possession of an animal that does not legally belong to you through our platform is strictly prohibited and may constitute pet theft or fraud. Any such attempts will result in an immediate permanent ban and will be reported to local law enforcement.



14. ACCOUNT REGISTRATION AND SECURITY

Registration is available to community members, rescue members, fosters, and the general public on a limited basis.

• We collect your Name, Username, Password, and Email Address. You are entirely responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account.
• Tracking: Found Rescue actively tracks the website activity of registered members to improve our services, monitor platform safety, and prevent fraud.
• Account Termination: Found Rescue reserves the right to suspend, disable, or terminate your account and restrict your access to our website and services at our sole discretion, at any time, for any reason, and without prior notice or liability.
• How do I delete my account? If you wish to delete your account, please request it by clicking here.
• How do I delete a report or post? If you wish to have your active listings, please request a report removal by clicking here.


15. COMMUNITY, FOSTER, AND ADOPTION APPLICATIONS

Whether you want to foster a dog, bottle-feed kittens, join our TNR trapping team, or adopt a pet, it all starts with an online application. This website may provide you with the ability to submit applications and inquire about becoming a community member, fostering, and adoption opportunities at Found Rescue. By submitting an application or information, you acknowledge and agree that:

• Information Collected: We will request complete details of the person. This includes, but is not limited to: Full Name, Phone Number, Email, Home Address, Driver’s License ID, number of pets in the household, personal and pet history, and references.
• Accuracy: You warrant that all information you submit is true, accurate, and complete. Providing false or misleading information may result in your immediate disqualification from consideration or, if approved, termination of any position approved for.
• Vetting & Application Review: This information is used to vet the applicant’s eligibility. Once we receive your application, our volunteer team will review it and reach out within 30 business days. We’ll schedule a brief, informal chat or orientation to go over safety protocols and make sure you feel completely equipped for your role.
• Approval Not Guaranteed: The submission of an application does not guarantee that you will be contacted, interviewed, or accepted. Found Rescue is under no obligation to review every application submitted. Found Rescue reserves the right to deny, reject, or revoke any foster, adoption, or volunteer application at our sole discretion based on our vetting process and the best interests of the animals. Found Rescue reserves the right not to inform the applicants about the status of a denial, rejection, or revocation of any foster, adoption, or volunteer application.
• Marketing Use: Information gathered during this application process will also be used by Found Rescue for marketing purposes.
• Separate Contracts: Approved fosters and adopters will be required to sign separate, legally binding Foster or Adoption Agreements. In the event of a conflict between these Terms and a specific Agreement, the specific Agreement shall prevail.


16. MARKETING, NEWSLETTERS, AND CONTACT POLICY

By submitting a report, registering an account, making a donation, or submitting an application, you agree to allow Found Rescue to contact you by email or phone regarding the found report, found pet, or your account. Furthermore, you expressly consent to:

• Having your Name, Email Address, and Phone Number added to the subscription of newsletters and marketing lists.
• Found Rescue using your submitted data—including Photos, GPS location, IP address, Pet Name, City, State, and Pet Status—for ongoing marketing, promotional, and operational purposes.
• SMS/Text Messaging: By providing your phone number, you consent to receive SMS/text messages from Found Rescue regarding your reports, applications, and marketing updates. Message and data rates may apply. You may opt-out of receiving promotional text messages at any time by replying "STOP" to any message you receive from us, or by contacting us directly.


17. THIRD-PARTY LINKS & ENDORSEMENTS

Our website may contain links to third-party websites or services (e.g., Stripe, Zelle, social media platforms, and wishlist retailers) that are not owned or controlled by Found Rescue. We assume no responsibility for the content, privacy policies, or practices of any third-party websites.

• No Endorsement: The inclusion of any third-party link, wishlist retailer, or community resource does not imply an endorsement, sponsorship, or recommendation by Found Rescue. We are not responsible for the quality, safety, or policies of any third-party goods or services.


18. DONATIONS & FUNDS

Found Rescue accepts donations through multiple systems to support our mission, cover marketing, support our foster homes, headquarters, staff, team members, wages, database, etc.

• Financial Donations: We accept credit/debit cards (through Stripe), Zelle, checks, cashier's checks, and money orders. When donating via card, we may collect billing information, which will be used for marketing purposes.
• Recurring/Monthly Donations: By enrolling in a monthly auto-donation, you authorize Found Rescue and our third-party payment processors to automatically charge your selected payment method on a recurring monthly basis. You may cancel your recurring donation at any time by logging into your account or contacting us directly. To prevent your payment method from being charged for the next billing cycle, cancellation requests must be processed prior to your next scheduled payment date.
• Non-Refundable: All financial donations made to Found Rescue—including processed recurring donations—are considered final and non-refundable.
• Allocation of Funds: You may direct your funds to specific areas like the Rescue Fund, the Reunion Fund, the TNR Fund, or the Foster Fund. However, they might be used to cover other services or operational costs as needed at our sole discretion.
• Supplies Donations: Because our animals recover in dedicated foster homes rather than a shelter, we are constantly in need of high-quality food and equipment.
• Wishlists: We have pre-selected our most urgent needs on our charity wishlists. Items added to your cart will ship directly to our doors.


19. HEALTH AND TEMPERAMENT DISCLAIMER

Found Rescue makes no representations, guarantees, or warranties regarding the health, age, breed, behavior, or temperament of any animal rescued, fostered, or adopted through our organization.



20. ASSUMPTION OF RISK

Animals can be unpredictable. By volunteering, fostering, or adopting through Found Rescue, you acknowledge that interacting with animals carries inherent risks, including but not limited to bites, scratches, property damage, and the transmission of zoonotic diseases. You voluntarily assume all such risks.



21. CAREERS & EMPLOYMENT APPLICATIONS

This website may provide you with the ability to submit applications, resumes, or inquire about employment opportunities at Found Rescue ("Career Information"). By submitting Career Information, you acknowledge and agree that:

• Accuracy: You warrant that all information you submit is true, accurate, and complete. Providing false or misleading information may result in your immediate disqualification from consideration or, if hired, termination of employment.
• No Guarantee of Employment: The submission of an application or resume does not guarantee that you will be contacted, interviewed, or hired. Found Rescue is under no obligation to review every application submitted.
• No Employment Contract: Nothing on this website or in the application process constitutes a contract of employment. Any employment with Found Rescue is "at-will," meaning either you or Found Rescue may terminate the employment relationship at any time, with or without cause, and with or without notice, unless expressly stated otherwise in a specific written employment agreement signed by an officer of Found Rescue.

• Company Status: Found Rescue is currently operating as a regular LLC and is not a 501(c)(3) tax-exempt non-profit organization. However, Found Rescue reserves the right to convert to a 501(c)(3) non-profit organization in the future.
• U.S. Audience Only: Our website and services are intended solely for users located within the United States. We make no representation that our services are appropriate or available for use outside the U.S. If you access our services from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

4. Any content or photos you upload to the platform.


25. SERVICE MODIFICATIONS AND INTERRUPTIONS

Found Rescue reserves the right to modify, suspend, or discontinue any part of our website or services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the service.
